LicencePro Driving Instructor Code of Conduct

1. Scope
This Code of Conduct applies to all driving instructors ("Instructors") who use the LicencePro booking platform ("Platform"). By accessing or using the Platform, you agree to comply with this Code in all aspects of your interactions on the Platform, including the conduct during all driver training sessions and any communications with Learners, prospective Learners, and other parties.
2. Consequences of Breach
Any breach of this Code of Conduct may result in disciplinary action at the sole discretion of LicencePro. Such action could include, but is not limited to, suspension or permanent removal from the Platform.
3. Purpose
The purpose of this Code is to set forth the standards of professionalism, courtesy, and ethical conduct expected of Instructors using LicencePro. This Code is intended to ensure that all Instructors provide safe, competent, and respectful driving instruction, thereby upholding the reputation and integrity of the Platform.
4. Compliance with Laws and Regulations
- Legal Requirements: Instructors must comply with all applicable Australian laws and the laws of the state or territory in which they operate. This includes holding a valid driver’s licence, any required driving instructor licences, and necessary clearances such as working with children checks and national police criminal history checks.
- Vehicle Standards: Instructors are responsible for ensuring that their vehicle is fully registered, roadworthy, and meets all statutory safety requirements at all times.
5. General Professional Conduct
- Professional Service: Instructors are expected to provide the full service that has been booked by a Learner. For example, if a one-hour session is booked, at least one hour of driving instruction must be provided.
- Punctuality and Preparedness: Instructors must arrive on time and be fully prepared for each session. If a session cannot be completed due to circumstances such as vehicle breakdown, illness, or an accident, the Instructor must promptly inform LicencePro and all affected Learners, offering suitable options for rescheduling or, if necessary, referring the Learner to another Instructor.
- Accurate Recording: Instructors must record all job details in the Platform’s Booking Calendar without delay. Failure to do so, particularly with the intent to circumvent the Platform, may result in the imposition of liquidated damages as specified in the Fee Schedule.
- Claiming Payment: Instructors should only claim payment through the Platform once a session has been fully completed.
6. Interpersonal Conduct and Professionalism
- Respect and Courtesy: Instructors must always treat Learners, prospective Learners, and all other contacts in a respectful and courteous manner.
- Quality Instruction: Instructors are expected to deliver high-quality, safe, and professional instruction at all times, setting a positive example for Learners.
- Prohibited Behaviours: Instructors must refrain from any conduct that could be perceived as offensive, defamatory, intimidating, abusive, or otherwise harmful to the reputation of LicencePro. This includes, but is not limited to, the use of inappropriate language or gestures and any behaviour that might cause Learners to feel unsafe or disrespected.
- Third-Party Interference: Instructors must not allow unapproved third parties to be present during training sessions. Exceptions may be made only where prior consent has been obtained from the Learner (or the Learner’s parent/guardian if the Learner is under 18).
7. Financial Integrity
- Transparent Payment: Instructors must only accept payments that are processed through the Platform. Any request for payment or benefit outside the agreed payment process is strictly prohibited.
- Independent Representation: Instructors must not present themselves as employees, agents, or representatives of LicencePro.
8. Discrimination and Equal Treatment
- Equal Opportunity: Discrimination on the basis of age, race, gender, sexual orientation, disability, marital status, or any other protected attribute is strictly prohibited.
- Fair Treatment: Instructors must treat all Learners fairly and without bias. Any form of unfavourable treatment or segregation is unacceptable.
9. Harassment and Unwelcome Behaviour
- No Harassment: Harassing behaviour, including sexual harassment, is not tolerated. Harassment is defined as any unwelcome behaviour that causes humiliation, intimidation, or distress.
- Appropriate Physical Contact: In the event that any physical contact is necessary as part of instruction, explicit consent must be obtained from the Learner beforehand.
- No Personal Relationships on the Job: Instructors should maintain a professional relationship with Learners. Any personal or romantic relationships during the provision of instruction are strongly discouraged.
10. Work Health and Safety
- Risk Management: Instructors must adhere to all applicable work health and safety laws and guidelines. This includes taking all reasonably practicable steps to manage risks associated with driving instruction.
- Safe Environment: Instructors must ensure that their vehicle is a safe environment for both themselves and Learners during training sessions.
11. Social Media and Public Representation
- Professional Use of Social Media: Instructors should not use social media or any other public forum in a manner that may bring LicencePro into disrepute.
- Accurate Representation: Any public statements or representations made by the Instructor regarding LicencePro or their services must be accurate and not misleading.
By using the LicencePro Platform, you acknowledge that you have read, understood, and agree to abide by this Code of Conduct. LicencePro reserves the right to amend this Code from time to time, and continued use of the Platform will constitute acceptance of any such changes.
